Man Who Endured 3-Enema Traffic Stop Awarded $1.6 Million

In an earlier post, I wrote about David Eckert being forced to undergo three enemas and a colonoscopy after a routine traffic stop even though x-rays revealed that he was not carrying drugs.

Eckert filed a lawsuit and was awarded $1.6 million.  Eckert also sued the hospital and the doctors that performed the procedures.  That part of the lawsuit is still ongoing

David Eckert, who was given three enemas as part of a humiliating search after a routine traffic stop last year, has received a $1.6 million settlement from a county and city in New Mexico.

Lawyers from the city of Deming and Hidalgo County agreed to the settlement earlier this week.

“It was medically unethical and unconstitutional,” his lawyer, Shannon Kennedy, told the Associated Press. “He feels relieved that this part is over and believes this litigation might make sure this doesn’t happen to anyone else.”

Getting Stopped in Deming, New Mexico, Involves Losing Your 4th Amendment Rights

On January 2, 2013, David Eckert rolled through a stop sign in a Wal Mart parking lot in Deming, New Mexico.  Now, you’d expect this to end with Eckert receiving a ticket and then going on his way, but not in Deming.

An officer claimed that he noticed Eckert’s “posture to be erect” and that “he kept his legs together.”  The officer suspected Eckert of carrying drugs, and that’s where the nightmare began.

Eckert then says he was forced to have three enemas and eventually a colonoscopy at 1 a.m. on Jan. 3, 2013. No drugs were ever found.

This was all done after an x-ray revealed he was not carrying drugs or anything else.  If you want more details (which get a little graphic), you can follow the link below.

Eckert has filed a lawsuit.  Good for him.

Apparently, this is becoming SOP in Deming.  Travelers and residents beware.
